Terms of use

The rules for using the monschool.app website and the Mon School portal, for schools, teachers, families and pupils.

1Purpose and acceptance

These terms govern access to and use of the monschool.app website (the "Website") and the Mon School portal (the "Portal"), published by AJ SRL (the "Publisher").

By using the Website or the Portal, you accept these terms. Schools are additionally bound by the subscription or pilot contract signed with the Publisher, which prevails in case of conflict.

2Definitions

"School": the educational institution that has subscribed to the service and administers its space.

"User": any person with an account on the Portal — member of the school leadership, teacher, parent or legal guardian, pupil.

"Content": any element published or transmitted through the Portal (texts, photos, documents, messages, grades, report cards).

3Access to the Portal and accounts

Accounts are created by the School (leadership, teachers, imported families) or by the parent themselves on invitation with a class code. Linking a parent to a child is subject to the School's approval.

A pupil's account is created only by the School. A pupil uses the Portal under the supervision of their School and legal guardians.

Credentials are personal and confidential. Each User is responsible for actions carried out from their account and must report any unauthorised use without delay to their School or to hello@monschool.app.

4Rules of use

The Portal is reserved for school communication between the School, its teachers, its pupils and their families. It is prohibited to:

  • publish or transmit content that is unlawful, abusive, discriminatory, violent or contrary to children's interests;
  • share other people's personal data (photos, documents, information) without permission;
  • impersonate another person or attempt to access spaces not intended for you;
  • use the service for commercial, advertising or data collection purposes;
  • disrupt the operation of the service (automated extraction, overloading, circumventing protections).

5Content

Users keep their rights over the Content they publish. They grant the Publisher the licence strictly necessary to host, display and transmit this Content to authorised recipients, within the service.

The School is responsible for the educational and administrative Content it publishes (announcements, grades, report cards, attendance) and for the accuracy of the data it imports.

The Publisher may remove Content that is manifestly unlawful or contrary to these terms, and informs the School.

6Availability and changes

The Publisher uses reasonable means to ensure the availability of the service, without guaranteeing uninterrupted operation. Maintenance operations may cause temporary unavailability; Schools are informed where possible.

The service evolves: features may be added, changed or removed. Substantial changes are announced to Schools.

7Plans and payment

Use of the Portal is free for teachers, families and pupils. Connecting a School is subject to a plan described on the Pricing page and to a subscription (monthly or yearly) or pilot contract.

Invoicing, payment, duration and termination terms are set out in the contract signed with the School, which prevails over these terms.

8Personal data

The processing of personal data is described in the privacy policy. For the Portal, the School is the data controller and the Publisher the processor, under a data processing agreement signed with the School.

9Intellectual property

The Website, the Portal, their code, design, documentation and the "Mon School" brand are the property of the Publisher. These terms do not transfer any rights, other than the right to use the service in accordance with its purpose.

10Liability

The Publisher is not liable for Content published by Users nor for educational or administrative decisions taken by the School using the service.

Where the Publisher's liability is engaged, it is limited to direct and foreseeable damage, up to the amounts paid by the School over the last twelve months, except in case of gross negligence or wilful misconduct and subject to mandatory legal provisions.

11Suspension and termination

The School may suspend or delete an account from its space at any time. The Publisher may suspend an account or access in the event of a serious breach of these terms, a security risk or at the request of a competent authority, informing the School.

At the end of the contract, the School may export its data; it is then deleted or anonymised according to the periods stated in the privacy policy.

12Changes to these terms

The Publisher may amend these terms. The version in force is the one published on the Website, with its update date. Substantial changes are notified to Schools before they take effect.

13Applicable law and disputes

These terms are governed by Belgian law. In the event of a dispute, the parties first seek an amicable solution. Failing that, the courts of [to be completed — judicial district of AJ SRL's registered office] have jurisdiction, subject to mandatory rules protecting consumers, including, for users located in Cameroon, those of Law No. 2010/012.
